Interpretaci\u00f3n en juicios y arbitrajes: tem\u00e1ticas muy t\u00e9cnicas y complicadas junto a informaci\u00f3n sensible<\/h2>\n

Hace un par de semanas, CGS Translations recibi\u00f3 el encargo de realizar durante siete jornadas de trabajo la interpretaci\u00f3n jurada del ingl\u00e9s al castellano y viceversa durante un arbitraje internacional. El arbitraje es un sistema extrajudicial de resoluci\u00f3n de conflictos que evita que las partes lleguen a los tribunales. Aqu\u00ed, el veredicto final est\u00e1 influido por la voluntad de llegar a un acuerdo y lo dicta al tribunal de arbitraje, es decir, una tercera parte imparcial.\u00a0<\/span>\u00a0<\/span><\/span><\/p>\n

No es de extra\u00f1ar que en un arbitraje, de tem\u00e1tica muy t\u00e9cnica y complicada, donde hab\u00eda en juego sanciones millonarias, se empleara un lenguaje t\u00e9cnico muy complejo y se expusiera informaci\u00f3n sensible.\u00a0 En un encargo de estas caracter\u00edsticas, CGS Translations tuvo que prepararse previamente a conciencia y hacer uso de sus 16 a\u00f1os de experiencia en Interpretaci\u00f3n jurada. Dado que el \u00e1rbitro y los abogados de la parte demandante y de la demandada estaban en un continente, el cliente y los int\u00e9rpretes estaban en otro y uno de los peritos expertos en otro pa\u00eds tambi\u00e9n, se tuvo que trabajar por Zoom y en modalidad consecutiva, por petici\u00f3n del \u00e1rbitro, para poder as\u00ed garantizar la exactitud de la interpretaci\u00f3n. Para garantizar la confidencialidad de las sesiones, se tuvo que firmar un acuerdo de confidencialidad, como es pr\u00e1ctica habitual, y realizar juramento al iniciar la primera sesi\u00f3n de trabajo, por supuesto.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

Asimismo, los int\u00e9rpretes jurados, as\u00ed como la mayor\u00eda de ling\u00fcistas profesionales no jurados, se rigen por un c\u00f3digo deontol\u00f3gico muy estricto, ya que acarrean una gran responsabilidad que exige el cumplimiento de unos est\u00e1ndares \u00e9ticos f\u00e9rreos. Adem\u00e1s de tener que ser fieles a la integridad del discurso, ser imparciales, no tener conflictos de intereses, poseer las credenciales y cualificaci\u00f3n adecuadas, y comportarse de forma profesional, deben ser siempre cuidadosos respecto a la confidencialidad. Como indica el c\u00f3digo deontol\u00f3gico de la AICE<\/span><\/a> (Asociaci\u00f3n de Int\u00e9rpretes de Conferencias de Espa\u00f1a):<\/span><\/p>\n

\u201ca) Los miembros de AICE deber\u00e1n respetar plenamente la confidencialidad de toda informaci\u00f3n derivada del ejercicio de su profesi\u00f3n, exceptuando aquella divulgada en reuniones abiertas.<\/span><\/p>\n

b) Los miembros de AICE en ning\u00fan caso podr\u00e1n obtener beneficios personales derivados de la informaci\u00f3n confidencial que puedan haber adquirido durante el desempe\u00f1o de su trabajo como int\u00e9rpretes de conferencia\u201d.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

En una \u00e9poca en la que estamos acostumbrados al f\u00e1cil acceso de la informaci\u00f3n y en la que las redes sociales difuminan el l\u00edmite de lo que se puede compartir, cobra gran importancia la experiencia y garant\u00eda de profesionalidad de los proveedores de servicios ling\u00fc\u00edsticos. CGS Translations se ha regido de forma estricta por estos c\u00f3digos todos estos a\u00f1os y en ning\u00fan caso revelar\u00eda el contenido de conversaciones, transcripciones o datos sujetos al secreto profesional sin el consentimiento por escrito del cliente.<\/span>\u00a0<\/span><\/p>\n
